Sale terms of OÜ Autoriehe

The owner of the online store www.agalerii.ee (hereinafter: the online store) is OÜ Autoriehe, registry code 10038067, address Vabaduse väljak 6, Tallinn, 10146 Harju County.


General terms of sales contract

The A-Galerii’s online store sells products sold in the A-Galerii store owned by OÜ Autoriehe (hereinafter: the goods).

The terms apply to the legal relationship that is formed between the customer (hereinafter: the customer) and Autoriehe OÜ, owner of the online store at www.agalerii.ee (hereinafter: the online store) in connection with the purchase of goods from the online store. In case no terms have been specified, the seller and purchaser shall abide by the legal requirements.

The seller reserves the right to amend these terms. Changes shall not be applied retrospectively.

The prices of the products sold in the online store are indicated next to the products. All the prices displayed in the online store are in euros and include the VAT applicable in the Republic of Estonia. The delivery cost shall be added to the price. The delivery cost depends on the purchaser’s location and the delivery method. The delivery cost is displayed when the purchaser places the order.

Product information is displayed next to the product in the online store. The product photos displayed in the online store may differ slightly from the actual look of the product. The prices or availability of the products may change without notice.

OÜ Autoriehe is the chief processor of personal data and forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.


Placing an order

The best way to order online is to register as a user in the online store. As a registered user, you will see your user information and updates on your orders under “My account”. After registering, the user has a valid username and password for logging in to the online store and placing orders.

To make a purchase from the online store, it is necessary to choose the desired products from the agalerii.ee store and add them to the shopping cart. You can view the products in the shopping cart, remove them, change their quantities or place an order by clicking on the button “View shopping cart”. Once you are convinced of the suitability of the products and their quantities, click on the button “Go to checkout”.

On the checkout page, fill in your name, address, e-mail and telephone number. As the prompt and trouble-free delivery of goods depends on the accuracy of this information, we ask you to verify that all of the information has been entered correctly. On the checkout page, different addresses may be chosen for delivery and billing.

Next, a suitable delivery and payment method should be selected on the checkout page, detailed descriptions of which are displayed below. When you have verified the accuracy of all information, click on the “Place order” button to confirm your order. Depending on the payment method you have chosen, you will then be redirected to pay for the goods via an Internet bank or credit card. If payment is successful, confirmation will be sent to the e-mail address stated in the order.

The seller reserves the right not to sell the ordered goods if the product price or properties shown in the online store are incorrect due to a human error or technical issues in the system, if the ordered goods are out of stock or if the purchaser does not comply with the online store sale terms as stated here. In such a case, the seller shall contact the purchaser and return the amount paid or offer a replacement product.

Should the purchaser have questions regarding the products or the placement of orders, these can be submitted to the seller’s e-mail address at pood@agalerii.ee.

The contract shall enter into force when the amount payable is transferred to the bank account of the online store.

If the ordered goods cannot be delivered due to stock running out or for any other reason, the purchaser will be informed as soon as possible and the amount paid (including the delivery cost) promptly refunded, but no later than within 14 days of sending the notification.


Payment methods

The seller uses the payment solution offered by Maksekeskus AS for the safe and easy collection of payments. You can pay for goods conveniently via the Swedbank, SEB, LHV, Nordea, Danske Bank and Krediidipank Internet banks or by MasterCard or Visa credit cards. Payments are accepted in euros.

When paying via an Internet bank, Maksekeskus AS or Autoriehe OÜ will automatically be displayed as the receiver of the payment. When paying with a Visa or MasterCard, the bank details of Autoriehe OÜ will be displayed on the purchaser’s bank statement.


Delivery

Once an order has been placed, the goods can be collected from the store at Hobusepea 2, Tallinn or received via the Omniva delivery service.

The purchaser bears the delivery cost and the respective price information is displayed next to the delivery method.

With Omniva, you can order the goods to be delivered to a suitable parcel terminal or post office or use the courier service. Omniva parcel terminals are located in 31 towns and cities around Estonia and parcels can be picked up from there 24 hours, 7 days a week. The parcel terminals are located in central areas outdoors and are always accessible.

The goods can be picked up from the chosen parcel terminal within five working days of receiving the order confirmation. If the order is placed from Monday to Friday before 15:00, the seller shall hand the goods over to Omniva the same day. Orders placed on Friday, Saturday and Sunday are shipped the following Monday. When the goods have arrived in the parcel terminal, the customer is notified via SMS of the door code, the location of the parcel terminal, the return code and the latest date for picking up the parcel.

The customer is obliged to keep the barcode on the parcel until the end of the 14-day return period to be able to exchange or return the goods if needed.

Within Estonia, parcels generally arrive at the chosen parcel terminal within 1-2 days of their shipment by the online store. Outside Estonia, goods are shipped within seven working days, after which the delivery speed depends on the postal service of the country of destination.

If the Omniva courier service has been selected as the delivery method, the goods will be delivered to the specified address within 2-4 working days of receiving the order confirmation. The Omniva courier service delivers parcels to homes and workplaces all over Estonia without any geographical limitations. The courier calls the recipient beforehand to agree on a suitable day and time of delivery. Should the courier be unable to reach the recipient, they will be notified via SMS or e-mail that the parcel has arrived at the post office. In addition, the courier will leave a notification in the purchaser’s mailbox.

If the goods have been ordered to be delivered to an Omniva post office, they can be picked up within 2-4 days of receiving the order confirmation. The customer will be notified via SMS when the goods have arrived at the post office.

Before placing an order, the customer is obliged to verify the accuracy of the contact details provided. The online store is not responsible for delays or misunderstandings in the delivery of goods that are caused by inaccurate or incorrect details being provided upon placing an order.

The online store has the right to ship goods within up to 45 calendar days in exceptional cases.

If the goods do not reach the customer in good condition and in a sealed package, the customer is obliged to notify the online store of this by sending an e-mail to info@agalerii.ee.

The prices of the delivery services are indicated on the checkout page.


Right of withdrawal or cancellation

The purchaser has the right to cancel the order before the seller has shipped it. The purchaser should notify the online store of their wish to cancel the order as early as possible at pood@agalerii.ee, noting the order number and payment information (name and account number).

After receiving the order, the purchaser has the right to withdraw from the contract entered into in the online store within 14 days.

The right of withdrawal does not apply if the purchaser is a legal person.

To exercise the 14-day right of withdrawal, the purchaser must not use the ordered goods in any way other than is necessary to ensure the nature, characteristics and functioning of the goods in the same way they would be allowed to test the goods in a physical store. If the goods have been used for any purpose other than is necessary to ensure the nature, characteristics and functioning of the goods, or if there are any signs of use or wear and tear, the online store has the right to lower the amount returned in accordance with the decrease in value of the goods.

The right of return does not apply if the goods are not in their original packaging or if the packaging has been damaged. To be able to return the product, the sticker attached to a piece of jewellery must be in place, demonstrating that the jewellery has only been worn for the purpose of trying the product. Otherwise, the seller shall not refund the purchaser for the goods or take back the product and shall return it to the purchaser.

To return the goods, the purchaser must submit an informal declaration of withdrawal to the e-mail address info@agalerii.ee within 14 days of receiving the goods.

The purchaser shall bear the cost of returning the goods, except in cases where the reason for the return lies in the fact that the product being returned does not comply with the order (e.g. a wrong or defective product). The purchaser must return the goods within 14 days of the submission of the declaration of withdrawal or submit evidence that they handed over the goods to the carrier within the aforementioned period.

Upon receiving the returned goods, the online store shall return to the purchaser (immediately but no later than within 14 days of receiving the declaration of withdrawal) all of the payments received from the purchaser based on the contract. The online store has the right to refuse to make the refund until the goods being returned are received or until the buyer has provided proof of returning the goods, whichever occurs first.

If the buyer has explicitly chosen a delivery method that differs from the cheapest ordinary delivery method offered by the online store, the online store is not obliged to reimburse the purchaser for expenses exceeding the cost of the ordinary delivery method.

The online store has the right to withdraw from the sale and demand that the goods be returned by the purchaser if the marked price of the goods in the online store is significantly lower than the market price of the goods due to an error.


Right to file a complaint

The online store is responsible for the non-compliance of goods sold to a purchaser with the terms of the contract or for deficiencies which already existed at the time of delivery and which occur within two years of delivering the goods to the purchaser.

Within the first six months of the delivery of the goods to the purchaser it is presumed that the deficiency already existed at the time of delivery. The obligation to disprove this presumption lies with the online store.

The purchaser has the right to contact the online store within two months of the occurrence of a defect by e-mailing info@agalerii.ee or calling +372 646 4101.

The online store is not liable for any defects arising after delivering the goods to the purchaser. If goods bought from the online store have defects for which the it is responsible, the online store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the online store shall return to the purchaser all of the payments involved in the sale contract.

The online store is not responsible for any deficiencies in the goods which have arisen due to their negligent handling.

The online store shall respond to the purchaser’s complaint within 15 days in a written format or in a format which can be reproduced in writing.


Processing of personal data

The online store uses the personal data provided by the purchaser (including their name, phone number, address, e-mail address and bank details) solely for the purpose of processing the order, delivering the goods to the purchaser and sending updates regarding important products or services, unless the purchaser has expressed their wish not to receive such updates.

The online store forwards personal data to the transport service provider in order to deliver the goods.

The purchaser may opt out of offers and newsletters sent to their e-mail address at any time by letting us know via e-mail or by following the instructions in an e-mail containing an offer.


Settlement of disputes

If the purchaser has complaints regarding the online store, these must be e-mailed to info@agalerii.ee or communicated by calling +372 646 4101.

If the purchaser and the online store are not able to settle the dispute by agreement, the purchaser may bring the matter before the Consumer Dispute Committee. The Consumer Dispute Committee is competent to resolve disputes arising from a contract between a purchaser and the online store.

A purchaser may also turn to the consumer dispute resolution body of the European Union.


Use of cookies

A-Galerii uses temporary cookies on its website to ensure the smooth functioning of the site. Cookies are small files which are transferred to the user’s computer and which are used to store sessions during the provision of online services. Their purpose is to remember and assist the website user.

Cookies contain information that cannot be personally identified. For example, they are used to save the user’s choices, to produce statistics and to determine how online store visitors use the website. This information is used to make the website even more convenient to use and to display visitor-specific information on the webpages.

Users may disable the use of cookies in their web browsers, but this may cause malfunctions when visiting webpages.
